Amicus Brief Filed By Alnylam Pharmaceuticals Argues That Funk Bros Is About Obviousness Not Patent Eligibility


Alnylam Pharmaceuticals is a biopharmaceutical company based in Cambridge, Massachusetts focused on developing synthetic "small interfering RNAs" (SiRNAs) as therapeutic agents. It has filed an amicus curiae brief in the Myriad gene patent case (AMP v. US PTO) that makes a number of insightful points, particularly in attempting to "debunk myths of Funk Brothers Seed Co. v. Kalo Inoculant Co."

Funk Brothers is generally assumed to be a case about patent eligibility. However, Alnylam points out that Funk Brothers was decided by the Supreme Court in 1948, prior to the enactment of the 1952 patent statute and thus prior to 35 USC 101, which is the statutory basis for the patent eligibility doctrine. Prior to 1952, the Court used the term “invention” to refer to "inventiveness," a concept that subsequent to 1952 and the enactment of 35 USC 103 we refer to as "nonobviousness." The Court in Funk Brothers found the claimed subject matter was not the “product of invention,” but Alnylam argues that post-1952 this statement should be interpreted a finding of obviousness, not patent ineligibility.

I have always found it extremely difficult, if not impossible, to find a principled distinction between the inventions claimed in Funk Brothers and Diamond V. Chakrabarty that would justify finding only Dr. Chakrabartys invention patent eligible. In Funk Brothers, the alleged invention was a novel and useful combination, in a single inoculant, of naturally occurring microorganisms in a combination that did not exist naturally. Chakrabarty’s invention was a novel and useful combination, in a single microorganism, of naturally occurring plasmids in a combination that did not exist naturally. It is important to bear in mind that Chakrabartys invention did not involve any genetic engineering at the molecular level.

In Funk Brothers, it has been pointed out that while the combination of bacteria in a single inoculant was novel, the bacteria function in the same manner and have the same characteristics as they would have in nature. But the same can be said regarding the plasmids Dr. Chakrabarty introduced into a single microorganism. These were naturally occurring plasmids, and in the claimed microorganism they encoded the exact same proteins, and performed the exact same function as they did in their natural state.

In a nutshell, Funk Brothers was a novel combination of naturally occurring bacteria capable of achieving novel and useful function, with the bacteria functioning in the same manner as they do in nature. Chakrabarty was a novel combination of naturally occurring plasmid DNA capable of achieving novel and useful function, with the plasmid DNA functioning in the same manner as they do in nature. I dont see how one invention can be patent eligible and the other not. However, if Funk Brothers was really decided based on obviousness rather than patent eligibility, as argued by Alnylam, the two decisions are easily reconciled.

Amgen Sues Hospira Claims That Biosimilar Version of Epogen Infringes



In Amgen v. Sandoz, a fractured panel of the Federal Circuit held that an applicant seeking approval of a biosimilar under the abbreviated BPCIA pathway is not required to participate in the so-called “patent dance,” and that if a biosimilar applicant fails to provide the reference product sponsor with its application and the other patent dance information, then the reference product sponsor’s only recourse is to bring a declaratory judgment action for patent infringement.
On September 18, Amgen did just that, filing a lawsuit against Hospira alleging that Hospira’s planned marketing of a biosimilar version of Amgen’s biologic Epogen (epoiten alfa) infringes Amgen patents.   The complaint is available here. 

Amgen states that this “is one of the first actions for patent infringement under 35 USC 271(e)(2)(C), which was enacted in 2010 as part of the” BPCIA.
According to the complaint, Hospira submitted its Biologic License Application (BLA) under the expedited subsection (k) pathway, relying on Amgen’s demonstration of the safety and efficacy of Epogen, but has failed to comply with the patent provisions of the BPCIA.  For example, Hospira has not provided Amgen with manufacturing information that “would have given Amgen the opportunity to evaluate the manufacturing processes used by Hospira to determine whether those processes would infringe any patents held by Amgen.”  This is essentially the same complaint Amgen had with respect to Sandozs application for expedited approval of a biosimilar filigrastim based on Amgen’s Neupogen product.
Amgen is also seeking a declaratory judgment that Hospira is required to provide Amgen with legally effective notice of commercial marketing of its biosimilar product, and information describing the processes or products used to manufacture the biosimilar product.  In Amgen v. Sandoz, the Federal Circuit held that a biosimilar applicant must provide notice to the reference sponsor on or after the date that the FDA approves its biosimilar application, but according to the complaint Hospira has refused to do so.

I am nothing if not easily distracted. Whats below is the kind of thing that creeps into my notebooks when I am supposed to be doing serious work.

If Meghan Trainors bouncy ode to the curvaceous posterior, "All About That Bass",


can spawn a Star Wars version, a high school literacy version, and a forties jazz  version, et al., I see no reason why we knitters should not have a version of our own. 

I sing like a screech owl and havent got the time to make a video (perhaps the Mason-Dixon ladies will oblige?), but heres my contribution to the boom boom on the dance floor.

All That Jazz

All That Jazz



In 1979 I saw the film “All
That Jazz” for the first time. 
 I sat in the movie theater
watching “Joe Gideon”, Bob
Fosse’s alter ego, destroying
 himself in the name of sex,
 drugs, and musical theater. 
On the way home, I had
 much to think of.  Fosse
had done me a fantastic favor.
 Somehow, he had touched my heart, communicated with me in a
 way no one else had.  A core
paradox had been laid out
with surgical simplicity:

1) To achieve your full potential
requires monomaniacal focus.

2) Monomaniacal focus
creates imbalance.

3) Imbalance leads to skewed
 values: Gideon was a man
turned inside-out, putting
his priorities on the very
things most likely to destroy him.

4) Premature self-destruction
prevents you from reaching
your full potential.

I don’t know about anyone
else, but that movie was a
 wake-up call on a massive,
soul-shaking level.  I was
determined to be the absolute
 best I could be, and the
path I saw to it was so rife
with peril that it was obvious
I’d be riding  a unicycle over
 a pool of sharks.   I puzzled
over this one for days, and
finally came to a life-changing
 conclusion: the safest thing
to be obsessive about was
BALANCE.  I would care
equally about all three basic
 aspects of my life: body,
mind, and emotions.  Then…
let the chips fall where they may.

I was twenty-seven years
old when I saw “All That
Jazz.”   Thinking about it
as deeply as possible,
whereas I’ve read books
and seen films that taught
me interesting things about
the world, works of fiction
stopped changing me on
any deep level at that point.
 NON-fiction continued to
 do so strongly until my
40’s, and from time to time
 I still get a little “bump”
from some piece of philosophy
 or physics or history.

But fiction?   No.  

On that level, stick a
fork in me, I’m done.  
I hear people speaking
 of fiction, books or films
or plays, that shakes them
 and changes their world
view or transforms them.
 I was wondering…what
was the last (or most recent)
 work that changed you, and
 how old were you when
that happened?

 suggest the same approach
 to balance.

 this, as do all of my other
